Terms of Service

1. Introduction

Welcome to Crush Rewards ("Crush," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Crush Rewards mobile application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use the Service. By using Crush, you represent and warrant that you meet these eligibility requirements.

3. Account Terms

You are responsible for maintaining the security of your account credentials. You agree to provide accurate, current, and complete information during registration. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Rewards & Tokens

CRUSH tokens are utility rewards you may earn through eligible activities on the Service. Eligible activities may include linking payment cards, submitting receipt data, running Crush Missions (including browser-extension price-check missions and shelf-scanning missions), and other activities Crush makes available from time to time.

CRUSH may be held in your wallet and redeemed or transferred only as the Service permits. Redemption options, values, and availability are subject to change. CRUSH is not offered as an investment, security, commodity, or other financial instrument, and holding or earning CRUSH does not entitle you to any ownership interest in Crush or to any guaranteed return.

4.1 Burns and contributor payouts

Crush generates revenue in part by sharing or selling anonymized and aggregated insights derived from contributor data, as described in our Privacy Policy. When that happens, Crush may:

  • (a) permanently remove ("burn") a portion of CRUSH tokens from circulation; and
  • (b) distribute a portion of CRUSH to eligible contributors whose data was used, as a contributor payout.

A contributor payout is a reward for data contribution. It is not a dividend, interest payment, profit share, yield, or investment return, and it does not mean CRUSH is a security or other financial instrument.

Burns do not remove CRUSH from your personal wallet balance. Crush determines whether a given data access or purchase triggers a burn and/or contributor payout, which contributors are eligible, and the amounts and timing of any such burn or payout. Those determinations may change. Nothing in these Terms promises that any particular data sale will result in a burn or a contributor payout, or that payouts will continue indefinitely.

5. Data Usage

By using the Service, you consent to the collection, anonymization, and aggregation of your spending and pricing data as described in our Privacy Policy. Your data is always anonymized before being shared with third parties. You may control what data you share through the app's settings. Proceeds from sharing or selling anonymized insights may be used in part for the burns and contributor payouts described in Section 4.1.

6. Prohibited Conduct

You agree not to:

  • (a) use the Service for any unlawful purpose;
  • (b) submit fraudulent or fabricated receipt data;
  • (c) attempt to manipulate or exploit the rewards system;
  • (d) reverse engineer or interfere with the Service; or
  • (e) impersonate another person or entity.

7. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, any unredeemed tokens may be forfeited. You may delete your account at any time through the app settings.

8. Limitation of Liability

To the maximum extent permitted by law, Crush Rewards and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount of rewards earned by you in the twelve months preceding the claim.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the app or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
